    Brilliant thread Hrishi.

Here is something we all really need to know and keep in mind.
There are no provisions in the Indian Penal Code, Criminal Procedure Code, Motor Vehicles Act, which prevents doctors from promptly attending to serious injured persons and accident cases before arrival of the police and their taking into cognizance of such cases, preparation of F.I.R. and other formalities by Police.

There can be no second opinion that preservation of human life is of paramount importance. This is so on account of the fact that once life is lost, the status quo ante cannot be restored, as resurrection is beyond the capacity of man

No. “The treatment of the patient should not wait for the arrival of the police or completion of legal formalities. All hospitals and doctors are required to provide immediate medical aid to all the cases, whether medico-legal or not “.
I find it disgusting when some doctors say that they will carry out operations only after a FIR is lodged or cops arrive. I mean the person could be dying for Christ's sake .

A friends friend met with an accident recently. And for some reason the doctors at one of the hospitals (forgot the name) refused to treat her until a FIR was lodged. Luckily she was taken to St. Johns where my friends aunt works as a doctor and was treated there.

I can't digest how these doctors do not value life over some stupid paper work.

you can never be sure MCL. probably the doc who treats the patient might face some issue with the cops later one, we are probably not aware of the procedure.

One of my friend who's brother is one of leading cardiologist in Mumbai told me that there are some recent amendments in Medico-legal cases wherein if even if the doc feels that its a medico-legal case patients safety is atmost priority. This was big relief to all doctors in india since this amendment allows doctors to treat the patient first and then eventually the patient/caregiver can file a police complaint. Not sure why this doctor behaved so weirdly.

Sumit, check my 2nd post on this thread. The quoted portion says.

No. “The treatment of the patient should not wait for the arrival of the police or completion of legal formalities. All hospitals and doctors are required to provide immediate medical aid to all the cases, whether medico-legal or not “.

i read that, but you know how cops behave, for them there are no rules. not may people are aware that a patient has to be treated whether or not an FIR is lodged with the cops.
