      Motor Vehicle Act - ( 2012 - Amendments)

      Cabinet approves amendments to Motor Vehicle Act
      New Delhi, March 01, 2012


      Soon, traffic rule violators will have to cough up hefty penalties - almost 10 times more than what they pay now - for offences such as overspeeding and drunk driving. The Union cabinet has approved the proposed Motor Vehicle Amendment Bill, the legislation that regulates road transport in the country, on Thursday.

      Framed in 1988, several provisions of the bill - especially those related to penalties for violations- have become completely ineffective in checking road accidents. The last time the MV Act was amended was in 2001.

      The bill, drafted by the road transport ministry, has made penalties for traffic offences much more stringent.

      Rash driving for example is now likely to attract a civil liability of upto Rs 5,000 in addition to punishment under the Indian Penal Code. Drunk driving will attract a penalty of Rs 5,000 and a two-year jail term.

      For the first time, a concept of graded fines for drunk driving is likely to be introduced. This means that penalty will be directly proportional to the alcohol content found above the stipulated limit of upto 30 mg per 100 ml of blood in the driver's body.


      • Cabinet approves ammendments to the Motor Vehicle Act.
      • Jumping red light for the first time can cost the offender Rs.500. The fine will be Rs.1000 for the second time and if repeated again it will go upto Rs.1500.
      • Offences like drink driving can put the offender behind bars for at least two years with Rs.5000 as fine.
      • The penalty for crossing speed limit will range between Rs.1000-Rs.1500.

      I guess this is a Good move by the Transport department and the Government. hopefully now we will have less accidents and less supercars being destroyed by these rich kids.

      IMO, In addition to the hefty penalties, there should be amendment to cancel driving licence after 3 or 4 offences.

      First of all speed limits need to be set properly. Bloody hell speed limit on the Chennai-pondi east coast road is 40km/hr apparently. Guys on cycles move faster than that!

      But for this you need to have a well designed roads, with enough bankings, medians and clear of encroachments. until we have these we cannot expect the increase in speed limit. I think we have speed limit set to as above as 90-100 kmph in some stretches of CHN-BNGL highway.

      I had seen 100kmph on Kunigal-Hassan road. But recently that has been removed and reduced to 80kmph

      More Amendments -

      According to the amended rule -


      • The penalty has also been hiked for jumping red lights and over speeding.
      • If a person gets certificate from a recognised driving school, he/she won't have to go for fresh test while applying for the licence.
      • In case of a minor is caught driving, the vehicle's owner will be up for prosecution.
      • New traffic fines as per the amended bill are - alcohol level to be graded from Rs 500 to Rs 3000.
      • penalty for using the mobile phone while driving will be Rs 500 to Rs 5000
      • not wearing seat belt while driving will attract a penalty of Rs 500 to Rs 1500.
      • Driving a vehicle without registration will lead to a fine of Rs 20,000 and/or one year in prison.
      • Penalty for not wearing a helmet will be Rs 1500.

      I understand that, Bangalore to Mangalore {Sorry henceforth it is BENGALURU & MANGALURU} highway {4 lane } work is going on briskly. Have you recently traveled on this stretch. What is the status? and specially 40 km Shiradi Ghat section?
