      Accident happened - Owner ok but driver has issues

      While coming back from work this evening, i banged into a swift (didn't know what happened, the brake didn't seem to work, due to rain water maybe?). It was a small hit and nothing major happened to my car, just the front left headlight assembly has been pushed inside a couple of inches, but the rear fender of the swift looks like a goner
      Parked the cars on the side, the cop at the nearby signal took down the vehicle numbers and asked us to either settle ourselves or go to the station and left (thank god).
      The swift was driven by a driver and there was a girl inside. He started talking non-stop in kannada and calling someone on phone. I phoned a couple of friends including Rahul (mclaren1885) who suggested I offer to pay the difference b/w the actual bill and their insurance settlement. The girl meanwhile came out and said that her husband was the owner and his office was a couple of kms away. So we decided to go to his office and settle the issue.
      The owner was a decent guy and he and his friend agreed for my offer. Now comes the funny part. The driver tells the owner not to leave me without me giving me any security. The owner had my number and asked my company details and was quite ok with us dealing with the insurance stuff tomorrow, but the driver wont agree. He was telling stuff like, "saar you don't know these people, they'll change the mobile number and escape, blah, blah..." and came to me with an offer to switch our DLs so that I will not cheat them. All this while the owner was trying to reason with the driver that he trusts me and nothing is needed. I lost my cool and asked the driver to either shut up or go to police. Only then he stopped his rant.
      Tomorrow we have decided to get an insurance estimate and then proceed accordingly. How much do you think would be the cost of a swift rear bumper (body coloured) and how much would insurance cover? Meanwhile, the owner's friend came up with a figure of 3500 and asked me if I am ready to pay that amount and settle, but I didn't agree.
      Also, how would the actual settlement work? They'll get the work done and would the bill amount clearly say what is paid by insurance and what has to be paid by the owner? He is pushing for me to pay for the no-claim bonus loss also. How to calculate that? Should I agree?
      Here are the pics of both the vehicles (you can hardly make out any damage in my car). Have to check in the morning properly.

      Ramesh, glad to know not much damage on either of the cars and all of you are unhurt.

      The Swifts rear bumper along with painting should be around 4k IIRC. Insurance will cover 50% of the cost. So you will have to bear the rest 50%.

      And yes, when you get the invoice for the repair it will clearly mention what amount the insurance will be paying and you will have to cover up for the balance accordingly.

      However, I am not sure what you must do about the NCB. Maybe the others can chip in.

      Ramesh, Thats bad.

      I think you may have to pay about 2.5K for the damage.

      But regarding the NCB, What if he claims for something else in the same insurance period ?

      Look like the plastic can be made to "pop" back out. If so, just a touch up paint job will suffice.

      I honestly think you should have paid that guy for how much ever the bumper+painting costs, since it was your fault cuz of which the accident occurred. Just imagine, how would it feel if someone banged into you for no fault of yours, and because of which you have to go through all the insurance formalities and all that, lose you NCB, leave your car at the garage for a few days, find an alternative transport etc. I understand if its some big accident where a big amount of money is involved, but for these small things, its always best to pay up.

      No offence Ramesh, just my thoughts.

      BTW, Swift rear bumper painting costs around 3k from MASS (Pritam Motors). I know this cuz i reversed into a parked Swift at the Forum Mall and got it repaired it for him. Have to say the Swift is a strong car, it just had a small scratch on the rear bumper, while one side of my Cedia's bumper came off slightly and the tail piece broke.

      My friend recently banged my car and paid the difference between bill and insurance. He has also agreed to pay the NCB in case I don't claim more insurance on my own this year. You should strike a similar NCB deal with the owner.

      If I were you, I would just pay the 3K and get out of the mess. Bumper is a plastic part and only 50% would be covered.
      I don't know what's gonna happen man but I wanna have my kicks before the whole shithouse goes up in flames

      This is exactly what has been agreed upon by me and the swift owner. The owner didn't know how much would be the cost of repair and his friend and especially the driver were coming up with stuff like the bumper, exhaust, tail-light etc have to replaced. It was as if the driver is trying to fleece me and was constantly messing around with the discussion that me and the owner were having. The owner kinda didn't know much about cars and obviously trusted the driver for his word.
      How do we calculate the NCB loss? The owner has asked me to find out from my side as well.

      Btw an update about my car.
      All is not good as it looked earlier. The bonnet is slightly bent and wouldn't lock in place properly. The left front headlight mounting is broken, probably need to replace the headlight assembly as a whole. The accident was a pile-up and someone had banged me from behind as well. Since there was no visible damage in the back and I was busy accessing the damage to the swift and my front, I didn't bother stopping that fellow. Today morning I see that I can't open my boot Need to rush to ford service today and get that sorted out. God help me in case I have any puncture with the spare wheel, tools and the air compressor locked in the boot.

      In the first year, NCB would be 20% of the Swift's insurance. ie, the swift will get a 20% NCB bonus when the owner renews insurance for the first time.
