      Good points put forth. Quickride, etc should provide a Form-16 for the folks earning money through their apps and while filing returns one furnishes this extra and pays taxes on income earned But it is not so simple... the thing is all the corporate companies are promoting their employees to do this to help in car pooling. In fact there is a banner saying to share your rides and earn money in my company This is going to snowball into a controversy soon, but as usual the relevant authorities will be sleeping till it all blows open...

      Within the company premises or policy this won't lead to issue as it is company responsibility on anything that happens. Outside is the one which would lead you to trouble

      I had asked Quick Ride and BlaBlaCar what they have to say regarding the legality of using their platforms to offer shared rides. These were the responses:

      Quick Ride:
      Constraint: As per Indian Motor Vehicles Act, private vehicles cannot carry passengers for commercial gains. Hence Car Owners and Co-Travelers are strictly limited by Law to share a private vehicle in a private capacity, and any other ‘Services’ are strictly forbidden. The Car Owner must not provide any additional services to the Co-Traveler in exchange for hiring charges.

      Solution: In view of the need, and keeping the constraints in consideration, Quick Ride has devised a solution. When a member (user of the Quick Ride platform) offers ride-share/carpool, she/he gets Quick Ride ‘ride points’ that can be used to avail a ride from someone else who is also part of this network. These points are strictly restricted for use - either for availing shared rides from others, or (as of now) for exchanging for fuel as if cost-shared by co-traveller. The system does not allow, or encourage, any cash transactions between members, or any redemption of points for cash
      And BlaBlaCar:
      Thanks for contacting us. We can understand your concerns about using BlaBlaCar after reading this news report. First of all, we’d like to reassure you that carpooling is legal.

      Our members are doing nothing illegal when offering rides on BlaBlaCar as long as they are sharing travel costs rather than making a profit.

      We do our best every day to find profiles that are trying to use BlaBlaCar in order to run an unofficial business, something that is absolutely contrary to the concept of the platform, based on sharing costs between individual travelers. When a member violates our T&Cs, we suspend their account to prevent them from using the platform.

      This is to ensure that we’re in line with the Motor Vehicles Act, 1988 (MVA), an act about those who make money from transporting passengers. By preventing members from making a profile while carpooling, we ensure that offering rides on BlaBlaCar is legal. To find out more:

      How do I know that it's OK to carpool?
      The relevant regulation in India is the Motor Vehicles Act, 1988 (MVA). The MVA does not include provisions disallowing carpooling. The MVA regulates Contract Carriages and Public Service Vehicles which carry passengers for ‘hire and reward’. The definition of Contract Carriages and Public Service Vehicles excludes ‘a private car which is only used occasionally for the giving of lifts against some payment’. Such private car providing occasional lifts against a payment which sets off the cost of a trip is not a vehicle in which passengers are carried for ‘hire or reward’.

      Although BlaBlaCar services involve facilitation of carpooling, BlaBlaCar does not encourage car-owners to make a profit or earn rewards through any other charges. BlaBlaCar automatically calculates a recommended price for every journey, ensuring that car owners do not receive reimbursement exceeding running costs. Therefore, private car owners do not require a permit for carpooling in India (as long as the private car owner does not operate for ‘hire or reward’). Please note that different interpretations to the MVA may apply for each state and we encourage you to take independent legal advice before proceeding

      These apps just try to justify themselves and carefully frame sentences which could be easily misinterpreted. The above statement shared by you is a perfect example.

      Taxi ride charges also include not only fuel charges but also vehicle maintenance along with driver salary, benefits and allowances.

      So when these apps say that they are asking passengers to share just the fuel costs, it's as good as collecting a fare because you cannot justify the exact fuel costs for that particular rude that you are sharing. Moreover you are sharing rides with strangers and not with friends or relatives and collecting the so called fuel charges amount to collecting a fare.

      Also the most important point to consider is your car insurance which clearly states that the vehicle should be used only for personal use other the insurance would be void. So what would happen in case of any accident? The insurance would be void and the owner / driver could be arrested. Since the insurance would be void the owner / driver would have to compensate the victims personally.

      Do you think in such a scenario these apps would come to the rescue? THINK...
